The Supreme Court Refuses To Legalise Same-Sex Marriage & We’re Back To Fighting For Basic Rights

The long-awaited decision of the highest judicial court declared that it cannot legalize same-sex marriages, stating that it’s an issue for the Parliament to decide. The court also issued a 3:2 ruling against adoption rights being granted to unmarried and queer persons.

While Chief Justice Of India, DY Chandrachud and Justice SK Kaul agreed that unmarried couples, including queer couples, can adopt a child, the other three justices disagreed.

This has taken India back to square one in terms of where it stands as far as basic human rights are concerned. The fight continues.

The Constitution Bench was headed by Chief Justice Of India, DY Chandrachud, along with four other judges, Justice Sanjay Kishan Kaul, Justice S Ravindra Bhat, Justice Hima Kohli and Justice PS Narasimha.
